Response to Motion for Dismissal / Memo on Motion for Judgment
1. From Item 3, the defense admits this is a godly case. The defense's statement never denied the use of godly powers in David's tricks. Thus David does not have to perform his tricks in the courtroom. So now the issue is about the ability to judge a case of godly nature. As stated in Memo 3, for over 20 years, I believe godly powers have been used to assist technology (and magicians now confirmed).
2. Minnesota Statute § 179.06 - I am the perspective employer of David, not employee. From Memo 3, the mob (employer by proxy) has been collecting the commission and keeping the credits from me.
3. "Usurpation of Godly powers, which as this Court is aware, is beyond the jurisdiction of this Court or any court of this earth." Let me restate - this is about godly powers, not Godly. Best I understand, there are many gods in the universe, guided by God's (assuming 1) plan. I'm not sure if that's what the defense was trying to distinguish. Since the perceived definition of God has resulted in over 1000 denominations, it's probably best to consider "God" and "gods" as undefined (or mostly) at this point, and perhaps, better/fully defined/understood in the future. In either instance, I realize this is an unprecedented case, and unusual, but I strongly believe a lawsuit of this nature can be decided in a United States courtroom. Hopefully, the Federal Judicial System and/or Judge Tunheim will concur.
4. Jurisdiction - The whole purpose of diversity in federal lawsuits is so that a case can be heard anywhere. From "Represent Yourself in Court" (attorneys Paul Bergman and Sarah Berman-Barrett), "with few exceptions, federal courts have the same personal jurisdiction as state courts located in the same state." Under the "Full Faith and Credit" clause of the U.S. Constitution, every state has to honor cases legally decided in other states.
From 1, this infers the existence of godly powers. This is an earth-shattering revelation. Why didn't David fess up earlier about having godly powers? From Memo 3, it's because the mob, in granting David Copperfield his powers, has been keeping the credits from Chris Roller, the source responsible for godly powers. Unless the defense has another explanation for concealing godly powers on the planet, the plaintiff would like to make a Motion for Judgment, for $50,000,000 and 10% of any future earnings.
